Terms of Service

Please read these Terms carefully before using the 360 QHSE platform. By creating an account or using our services, you agree to be bound by these terms.

1. Definitions

  • "Agreement"means these Terms together with our Privacy Policy and Cookie Policy.
  • "Platform"means the 360 QHSE SaaS application accessible at 360qhse.co.uk.
  • "Customer"means the organisation or individual who subscribes to the Platform.
  • "User"means any individual authorised by the Customer to access the Platform.
  • "Content"means all data, records, and files uploaded or created by the Customer.
  • "We / Us / Our"means 360 QHSE Ltd, registered in Scotland.

2. Acceptance of Terms

By registering for an account or using the Platform, you confirm that you have read, understood, and agree to these Terms. You must be at least 18 years of age and have legal authority to enter into this Agreement on behalf of your organisation.

3. Subscription Plans and Pricing

We offer the following subscription plans, billed in GBP (exclusive of VAT):

We reserve the right to change pricing with 30 days' written notice to existing subscribers.

4. Free Trial

We offer a 30-day free trial for new customers. No credit card is required to start. At the end of the trial period, you must subscribe to a paid plan to continue. Trial data is retained for 14 days after expiry, after which it may be permanently deleted.

5. Payment and Billing

  • Subscriptions are billed monthly or annually in advance via Stripe.
  • Payment is due on the subscription start date and on each renewal date thereafter.
  • All payments are non-refundable except as expressly stated in Section 6.
  • If a payment fails, we allow a 7-day grace period to update payment details. Failure to resolve may result in suspension.
  • We do not store card details. All payment processing is handled securely by Stripe, Inc.

6. Cancellation and Refunds

You may cancel at any time via account settings or by emailing [email protected].

  • Monthly subscriptions: Cancellation takes effect at the end of the current billing month. No partial refunds.
  • Annual subscriptions: If you cancel within 14 days of renewal, you are entitled to a pro-rata refund for unused months.
  • Trial cancellations: No charge applies if you cancel before the trial period ends.
  • We reserve the right to terminate your account for breach of these Terms, in which case no refund will be issued.

7. Acceptable Use

You agree not to use the Platform to:

  • Violate any applicable law, regulation, or third-party rights
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorised access to any part of the Platform
  • Reverse engineer, decompile, or disassemble the Platform
  • Resell or sublicense access to the Platform without our written consent
  • Store or transmit material that is unlawful, defamatory, or discriminatory
  • Interfere with the integrity or performance of the Platform

8. Intellectual Property

Our IP: The Platform is owned by 360 QHSE Ltd and protected by UK and international intellectual property law. You are granted a limited, non-exclusive, non-transferable licence to use the Platform for your internal business purposes during your subscription.

Your Content: You retain full ownership of all Content you upload. By uploading Content, you grant us a limited licence to host and process it solely to provide the service. We will never use your Content for any other purpose.

9. Data Protection

We process personal data in accordance with UK GDPR and our Privacy Policy. A Data Processing Agreement is available on request.

10. Availability and Uptime

We target 99.9% uptime for Professional and Enterprise plans, measured monthly excluding scheduled maintenance. We will provide at least 48 hours' notice of planned maintenance where possible. The Starter plan is provided on a commercially reasonable efforts basis.

11. Limitation of Liability

  • Our total aggregate liability shall not exceed the total fees paid by you in the 12 months preceding the claim.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • We shall not be liable for any failure or delay caused by circumstances beyond our reasonable control (force majeure).

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

12. Disclaimer of Warranties

The Platform is provided "as is" and "as available". The Platform is a management tool and does not constitute legal, compliance, or professional advice.

13. Termination

Either party may terminate this Agreement at any time by providing written notice. Upon termination:

  • Your access to the Platform will cease at the end of the current billing period.
  • We will retain your Content for 30 days post-termination, during which you may request an export.
  • After 30 days, your Content will be permanently deleted from our systems.
  • Provisions that by their nature should survive termination will continue to apply.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. Both parties agree to attempt good-faith negotiation for 30 days before commencing legal proceedings.
